The terms that govern your use of the Optisys website and content.

These Terms of Service ("Terms") govern your access to and use of the website optisys.ai and any related tools, assessments, or content (together, the "Site") operated by Optisys FZ-LLC ("Optisys", "we", "us"). By accessing the Site you agree to these Terms. If you do not agree, please do not use the Site.
You may use the Site for lawful, informational, and business enquiry purposes. You agree not to:
All content on the Site, including the Optima suite of diagnostic frameworks (Optima Flow®, Optima AI®, Optima Factory®, Optima Demand®, Optima Supply®), scoring methodologies, written insights, graphics, and code, is owned by Optisys or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to view and use the Site for your internal, non-commercial purposes. All other rights are reserved.
Assessments, readiness scores, benchmarks, and other diagnostic outputs available through the Site are provided for informational purposes. They are generated from the inputs you provide and from general models, and they do not constitute financial, legal, engineering, medical, food-safety, or investment advice. You are responsible for how you apply the outputs to your business. A formal Optisys engagement is governed by a separate written services agreement.
The Site may link to third-party websites and rely on third-party services (for example, scheduling, analytics, or hosting providers). We are not responsible for the content, availability, or practices of those third parties. Your use of them is governed by their own terms.
Information you submit through the Site's forms is handled in line with our Privacy Policy. Do not submit anything you consider confidential or trade-secret through the website; confidential materials should be exchanged only under a signed engagement or NDA.
The Site and all content are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Optisys and its owners, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site. Our aggregate liability arising out of or related to the Site is limited to the greater of USD 100 or amounts you have paid Optisys under a written services agreement in the 12 months preceding the claim.
You agree to indemnify and hold harmless Optisys from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws principles. Any dispute arising from or related to these Terms or the Site is subject to the exclusive jurisdiction of the competent courts of Dubai, UAE.
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
